Crops failed after using defective seed.

The plaintiff, a commercial tomato grower, purchased “Roma” seed from Western Hybrid Seeds, Inc. The seed produced hollow tomatoes.

The plaintiff alleged that Western Hybrid Seeds, Inc. sold a defective and inappropriately labeled product.
